Eugene Volokh Endorses McCain

Voting for McCain Tomorrow:

It’s been hard for me to choose, but I’ve decided to vote for John McCain in tomorrow’s California primary.

I’d vote for either of the Republican candidates in November, and I have some reservations about both. Still, I think that McCain is likely to be very good on defense and on spending, and I think he’s eminently electable (not the only criterion, but a very important one). I’m also moved by the views of many lawyers and scholars I know and respect as serious conservatives — such as Ted Olson, Miguel Estrada, John McGinnis, and Stephen Calabresi — who argue that McCain will do a very good job on judicial appointments.

This having been said, I disagree with McCain about restrictions on campaign-related speech, and I’m uncomfortable with his occasional streak of economic populism. But the fact is that no Republican candidate is likely to be a perfect match for my views; and I think that on balance he’s the one I’d prefer as my party’s candidate this November. So that’s one reporter’s opinion. We’ll see what others think tomorrow, and during the rest of the campaign.

    “I’d vote for either of the Republican candidates in November…”. You seem to be forgetting that there are currently FOUR Republican candidates vying for the nomination. This oversight seems even more shocking when taking into consideration that this is a pro-gun blog and you didn’t mention the most pro-gun candidate of them all: Ron Paul. McCain and Romney have both supported anti-gun measures in the past. McCain has loudly and publicly supported background checks at gun shows for almost 10 years. In 2004 Romney, as governor, signed an “assault weapons ban” in Massachusetts. Ron Paul has been in congress for 20 years. He’s voted against gun bans 100% of the time and has introduced legislation to allow firearm owners to carry in national parks (H.R. 1897) and to repeal the Brady Handgun Violence Act and Federal Firearms License Reform Act (H.R. 1096).

    How could you overlook the only true conservative and the only pro-gun candidate on the ballot?

    Grant seems to be forgetting that there are at least six Republican candidates vying for the nomination - and frankly, I was very close to voting for John Cox. Grant is correct in noting that Paul is the closest thing to a conservative (as opposed to a neo-conservative) that we have on this ballot.

    I guess the Dem’s can finally get that national “Gun Show Loop Hole” bill passed if he’s elected President, seeing as how he supported and even did TV ads in favor of the same bills in Oregon and Colorado.

    No, I’m not going to vote for McCain…ever.
